Actul normativ amintit a fost publicat \u00een Monitorul Oficial al Rom\u00e2niei, Partea I, nr. 474 din 6 mai 2021 \u015fi a intrat \u00een vigoare la data public\u0103rii.<\/p>\n<p>Principalele modific\u0103ri legislative aduse prin OUG nr 36\/2021 vizeaz\u0103:<\/p>\n<p><strong>1. Utilizarea semn\u0103turii electronice \u00een raporturile de munc\u0103<br \/>\n<\/strong>\u00cen vederea flexibiliz\u0103rii \u0219i simplific\u0103rii rela\u021biilor de munc\u0103, Codul muncii a fost completat cu prevederi referitoare la posibilitatea angajatorului \u0219i a salariatului de a opta pentru utilizarea la \u00eencheierea contractului individual de munc\u0103 sau actului adi\u021bional la contract, dup\u0103 caz, a semn\u0103turii electronice avansate sau calificate, \u00eenso\u021bite de marca temporal\u0103 electronic\u0103 sau marca temporal\u0103 electronic\u0103 calificat\u0103 \u0219i sigiliul electronic al angajatorului (\u201esemn\u0103tura electronic\u0103\u201d).<br \/>\nPrin actul normativ au fost introduse dispozi\u021bii cu privire la:<\/p>\n<p><strong>a) Utilizarea semn\u0103turii electronice<br \/>\n<\/strong>Angajatorul poate opta pentru utilizarea semn\u0103turii electronice pentru \u00eentocmirea tuturor \u00eenscrisurilor\/documentelor din domeniul rela\u021biilor de munca rezultate la \u00eencheierea contractului individual de munc\u0103, pe parcursul execut\u0103rii acestuia sau la \u00eencetarea contractului, \u00een condi\u021biile stabilite prin regulamentul intern si\/sau contractul colectiv de munca aplicabil. De asemenea, angajatorul poate utiliza semn\u0103tura electronic\u0103 inclusiv \u00een raporturile acestuia cu institu\u021biile publice, la \u00eentocmirea \u00eenscrisurilor\/documentelor din domeniul rela\u021biilor de munc\u0103\/ securit\u0103\u021bii \u0219i s\u0103n\u0103t\u0103\u021bii \u00een munc\u0103.<br \/>\n<strong>b) Arhivarea electronic\u0103<br \/>\n<\/strong>Contractele individuale de munc\u0103 \u0219i actele adi\u021bionale \u00eencheiate prin utilizarea semn\u0103turii electronice se arhiveaz\u0103 de c\u0103tre angajator \u00een arhive electronice care vor fi puse la dispozi\u021bia organelor de control competente, la solicitarea acestora.<br \/>\n<strong>c) Cerin\u021ba formei scrise<br \/>\n<\/strong>Forma scris\u0103 a \u00eenscrisurilor, cerin\u021b\u0103 ad validitatem la \u00eencheierea contractului individual de munc\u0103, se considera \u00eendeplinit\u0103 \u0219i dac\u0103 \u00eenscrisul este \u00eentocmit \u00een form\u0103 electronic\u0103 \u0219i este semnat cu semn\u0103tura electronic\u0103.<br \/>\n<strong>d) Angajatorul nu poate obliga salariatul s\u0103 foloseasc\u0103 semn\u0103tura electronic\u0103<br \/>\n<\/strong>Angajatorul nu poate obliga persoana selectat\u0103 \u00een vederea angaj\u0103rii ori, dup\u0103 caz, salariatul, s\u0103 utilizeze semn\u0103tura electronic\u0103, la \u00eencheierea contractului individual de munc\u0103\/actului adi\u021bional la contract sau a altor documente emise \u00een executarea contractului individual de munc\u0103, dup\u0103 caz.<br \/>\n<strong>e) Utilizarea aceluia\u0219i tip de semn\u0103tur\u0103 la semnarea documentelor<br \/>\n<\/strong>La \u00eencheierea contractului individual de munc\u0103\/actului adi\u021bional la contract sau a altor documente emise \u00een executarea contractului individual de munc\u0103, dup\u0103 caz, angajatorul \u0219i salariatul trebuie s\u0103 utilizeze acela\u0219i tip de semn\u0103tur\u0103, respectiv semn\u0103tura olograf\u0103 sau semn\u0103tura electronic\u0103.<br \/>\n<strong>f) Posibilitatea angajatorului de a suporta cheltuielile pentru achizi\u021bionarea semn\u0103turilor electronice<br \/>\n<\/strong>Angajatorul poate suporta, \u00een vederea \u00eendeplinirii obliga\u021biilor legale men\u021bionate \u00een ordonan\u021ba de urgen\u021b\u0103, cheltuielile pentru achizi\u021bionarea semn\u0103turilor electronice, utilizate pentru semnarea \u00eenscrisurilor\/documentelor din domeniul rela\u021biilor de munc\u0103\/securit\u0103\u021bii \u0219i s\u0103n\u0103t\u0103\u021bii \u00een munc\u0103.<\/p>\n<p><strong>2. Completarea dispozi\u021biilor privind munca la domiciliu<br \/>\n<\/strong>Prin actul normativ s-a introdus obliga\u021bia salaria\u021bilor care desf\u0103\u0219oar\u0103 munca la domiciliu de a respecta \u0219i de a asigura confiden\u021bialitatea informa\u021biilor \u0219i documentelor utilizate \u00een timpul muncii la domiciliu.<\/p>\n<p><strong>3. Modificarea \u0219i completarea Legii nr. 81\/2018 privind reglementarea activit\u0103\u021bii de telemunc\u0103<br \/>\n<\/strong>Conform sursei citate, dispozi\u021biile prev\u0103zute de ordonan\u021ba de urgen\u021b\u0103 stabilesc urm\u0103toarele modific\u0103ri \u0219i complet\u0103ri \u00een legisla\u021bia privind telemunca:<br \/>\n(a) defini\u021bia telemuncii a fost simplificat\u0103, \u00een sensul c\u0103 a fost eliminat\u0103 sintagma \u201ecel pu\u021bin o zi pe lun\u0103\u201d din vechea defini\u021bie. Astfel, potrivit reglement\u0103rii actuale, telemunca este \u201eforma de organizare a muncii prin care salariatul, \u00een mod regulat \u0219i voluntar, \u00ee\u0219i \u00eendepline\u0219te atribu\u021biile specifice func\u021biei, ocupa\u021biei sau meseriei pe care o de\u021bine \u00een alt loc dec\u00e2t locul de munc\u0103 organizat de angajator, folosind tehnologia informa\u021biei \u0219i comunica\u021biilor\u201d;<br \/>\n(b) de la data intr\u0103rii \u00een vigoare a ordonan\u021bei de urgen\u021b\u0103, angajatorul are posibilitatea de a verifica activitatea salariatului prin utilizarea tehnologiei informa\u021biei \u0219i comunica\u021biilor, \u00een condi\u021biile stabilite prin contractul individual de munc\u0103, regulamentul intern \u0219i\/sau contractul colectiv de munc\u0103, dup\u0103 caz;<br \/>\n(c) p\u0103r\u021bile nu mai sunt obligate s\u0103 includ\u0103 clauza privind locul\/locurile desf\u0103\u0219ur\u0103rii activit\u0103\u021bii de telemunc\u0103, \u00een contractul individual de munc\u0103\/actul adi\u021bional de telemunc\u0103;<br \/>\n(d) dispozi\u021biile privind obliga\u021biile salariatului se completeaz\u0103, \u00een sensul c\u0103, salariatul are obliga\u021bia de a respecta \u0219i asigura confiden\u021bialitatea informa\u021biilor \u0219i documentelor utilizate \u00een timpul desf\u0103\u0219ur\u0103rii activit\u0103\u021bii de telemunc\u0103;<br \/>\n(e) angajatorul are obliga\u021bia de a asigura condi\u021biile pentru ca telesalariatul s\u0103 primeasc\u0103 o instruire suficient\u0103 \u0219i adecvat\u0103 \u00een domeniul securit\u0103\u021bii \u0219i s\u0103n\u0103t\u0103\u021bii \u00een munc\u0103, \u00een special sub form\u0103 de informa\u021bii \u0219i instruc\u021biuni de lucru privind utilizarea echipamentelor cu ecran la vizualizare, fiind eliminat\u0103 sintagma \u201especifice locului de desf\u0103\u0219urare a activit\u0103\u021bii de telemunc\u0103\u201d.<\/p>\n<p><strong>4. Completarea Legii nr. 319\/2006 a securit\u0103\u021bii \u0219i s\u0103n\u0103t\u0103\u021bii \u00een munc\u0103<br \/>\n<\/strong>Prin complet\u0103rile aduse de O.U.G. nr. 36\/2021 s-a stabilit c\u0103 dovada instruirii \u00een domeniul securit\u0103\u021bii \u0219i s\u0103n\u0103t\u0103\u021bii \u00een munc\u0103 poate fi \u00eentocmit\u0103:<br \/>\n(a) \u00een format electronic, prin semnarea cu semn\u0103tur\u0103 electronic\u0103 avansat\u0103 sau calificat\u0103, \u00eenso\u021bit\u0103 de marca temporal\u0103 electronic\u0103 sau marca temporal\u0103 electronic\u0103 calificat\u0103 \u0219i sigiliul electronic calificat al angajatorului, sau<br \/>\n(b) pe suport h\u00e2rtie, prin utilizarea semn\u0103turii olografe.<\/p>\n<p>Dovada instruirii se realizeaz\u0103 \u00een func\u021bie de modalitatea aleas\u0103 de c\u0103tre angajator, stabilit\u0103 prin regulamentul intern. Normele de aplicare a prevederilor Legii nr. 319\/2006 vor fi modificate \u00een consecin\u021b\u0103, \u00een termen de 60 de zile de la intrarea \u00een vigoare a ordonan\u021bei de
